There were amendments to the bill in that were perceptively in our favour. However, one of the amendments was the removal of the only part of the Bill which referenced “actual” Tobacco (?): “Bill 60 will proceed without reference to flavoured tobacco or flavoured e-cigarette juice. Government will consult with Nova Scotians on these products that target youth.”

The reference to banning flavoured tobacco was the one point that made sense in the entire proposed Bill, and though the opposition tried despirately to convince the government to leave that reference in the bill, it was removed.

While there will be many unintended consequences that will be discovered along the way, what this means to Nova Scotia Electronic Cigarette businesses at this point is that vendors will have to treat e-cigarettes the same as regular cigarettes:

  • keep them out of view, unless the store sells only e-cigarettes and minors are not permitted entry
  • no point-of-sale promotion
  • no selling to minors (youth under 19)
  • no selling in pharmacies and other places where tobacco sales are prohibited

Adult Nova Scotians (19 and older) will continue to have access to e-cigarettes from most current vendors.

While e-cigarettes are being treated like regular cigarettes in retail settings, they will not be taxed as a tobacco product.

ECTA is Presenting at Nova Scotia Legislation (Bill 60 Opposition) http://ectaofcanada.com/ecta-is-presenting-at-nova-scotia-legislation-bill-60-opposition/ Tue, 04 Nov 2014 00:32:11 +0000 http://ectaofcanada.com/?p=286 ECTA Chair, Daniel David will be presenting to the Law amendments committee in opposition of Nova Scotia Bill 60 (Amendments to the Smoke-free Places Act and Tobacco Access Act) at the Province House in Halifax tomorrow (November 3rd, 2014) at 4:30pm ET.

The presentations begin at 1:30pm ET and they have more than 20 speakers from what we have been told.

“Effectively”, by classifying Electronic Cigarettes as a Tobacco Product, Nova Scotia is banning Electronic Cigaretes and they don’t even realize it yet. Everything from the Tobacco Act applies to E-Cigarettes, automatically.

This bill will effectively classify Electronic Cigarettes as tobacco products regardless of whether or not they contain nicotine (which also does not justify a tobacco classification in and of itself).

The result of this bill will mean:

  • No Sales to Minors (which is the ONE point that we agree with)
  • No Vaping in Public Spaces
  • No Displays or Marketing in Retails Spaces
  • No Flavours (except Tobacco and Menthol)
  • No Vaping in Vape Shops
  • Among other things yet to be realized

Call to Action – NS Bill 60 Amendment Affects EVERYBODY http://ectaofcanada.com/call-to-action-ns-bill-60-amendment-affects-everybody/ Mon, 27 Oct 2014 23:12:16 +0000 http://ectaofcanada.com/?p=270 This is a call to action that WILL affect our future in Electronic Cigarettes, Vaping in general and your access to these products.

The Nova Scotia Health Minister, Leo Glavine has introduced an Amendments to Tobacco Legislation in Bill 60.  Details can be found here: http://novascotia.ca/news/release/?id=20141024003

Effectively, these amendments would treat Electronic Cigarettes as Tobacco in virtually all aspects.  No more vaping in public, no more visible products, no more flavours and no more vaping in vape shops.

If these amendments pass, this will set the standard for the entire country.  Also, of special note, during the HESA Meeting No. 37 in the House of Commons last Tuesday (Oct 21st), Hillary Geller (Assistant Deputy Minister, Healthy Environments and Consumer Safety Branch, Health Canada) specifically said that they were working closely with Nova Scotia to establish regulation.

As such, this is clearly not just a Nova Scotia problem!  What happens there, WILL propagate, if successful.

There is currently a petition on Change.org that, at a minimum, we are asking ALL Canadians to sign.  Yes, we know, “another online petition” but this one is serious and has been confirmed that results will go directly to the Health Minister.  Change.org is “cool like that.”
